Dudley Services is a highly experienced asbestos abatement contractor serving the Greater Boston Area.  We have extensive experience addressing emergency asbestos removal issues.  In general, the Massachusetts Department of Environmental Protection (DEP) requires that all asbestos activities be notified 10 working days prior to the job commencement.

However, in the event that there is asbestos that needs to be removed immediately and it is a hardship to wait the mandatory 10 working days required for notification, the state of Massachusetts has implemented a waiver number procedure. The steps required to obtain a waiver number are listed below:

• First you should call Massachusetts Department of Environmental Protection. Their number is 1-978-694-3264 .  The homeowner is required to call unless they are unable to be contacted, incapable of making the call, or you manage the property on their behalf. When you call be sure to ask for the asbestos department.
• You should be connected to an asbestos inspector, if not, you can leave a message on the voice mail system provided (be sure to include the information below in your message). Keep in mind this is a state funded agency and they try to keep things as efficient as possible.
• When you get an inspector on the line, explain the situation (re: cracked or leaking heating plant, leaking pipe, contamination hazard, unforeseen circumstance, etc.).
• The inspector will ask for the property owners name, the address of the property and the amount of asbestos that requires removal at this time (most residential heating plants have 20 square feet of asbestos and about 10 linear feet of associated asbestos pipe insulation for standard heating plant replacements).
• The inspector will then grant you a waiver number. Please remember to get the inspectors name (this is needed for the asbestos contractors notification papers).
• Once you receive the waiver number you must then call the licensed asbestos contractor of your choosing and give them the number and inspectors name. An asbestos contractor is required to have a waiver number before any abatement activity. Keep in mind that waiver numbers are good for 5 working days from the date they are issued.
• Once the asbestos contractor receives this number from you, they are required to call the Department of Occupational Safety and obtain a second waiver number. They should also check to see if the local health department requires any permitting procedures or fees.

If you have a question about whether an asbestos contractor has performed the correct notification procedures, you could request they present you the transmittal number they received by completing and submitting form ANF-OO1. This transmittal number is how the state keeps track of each individual abatement project. The State Program Administrators request that users not abuse the waiver system and keep its use solely for emergency purpose.
